about these terms

These terms of use govern your access to and use of the kirri website, online store, content, services and related digital experiences.

In these terms, “kirri”, “we”, “us” and “our” refer to Scent Australia Home Pty Ltd, ABN 82 629 688 124, trading as kirri.

By accessing our website, creating an account or placing an order, you agree to these terms and any policies referred to within them.

If you do not agree to these terms, please do not use the website.

Nothing in these terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, including your rights under Australian Consumer Law.

using our website

You may use our website for personal, lawful purposes and to learn about or purchase kirri products and services.

You must not:

  • use the website for an unlawful, fraudulent or misleading purpose
  • interfere with the security, operation or availability of the website
  • attempt to gain unauthorised access to our systems or another person’s account
  • introduce viruses, malicious code or other harmful material
  • scrape, copy, extract or reproduce website content through automated means without our written permission
  • impersonate another person or provide false information
  • use the website or its content in a way that infringes another person’s rights
  • use our products, imagery, content or trade marks for unauthorised resale, advertising or commercial activity

We may restrict or suspend access to the website where we reasonably believe these terms have been breached or where necessary to protect kirri, our customers or our systems.

eligibility

You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order through our website.

By placing an order, you confirm that you have the legal capacity and authority to enter into the transaction.

accounts

You may be able to create an account to manage orders, subscriptions, preferences or other services.

You are responsible for:

  • providing accurate and current information
  • keeping your login details secure
  • restricting access to your account and devices
  • notifying us promptly if you suspect unauthorised access
  • activity carried out through your account, except where caused by our failure to take reasonable care

We may ask you to verify your identity before providing account information or making changes to an account.

We take reasonable care to keep the information on our website accurate and current. From time to time, information may contain errors, omissions or outdated details.

We may correct errors and update website content where reasonably necessary. Changes to website content will not alter an order that we have already accepted unless we contact you and you agree, or the change is required by law.

Website content is provided as general information and is not professional, medical or technical advice.

product descriptions

We aim to describe and display our products as accurately as reasonably possible.

The appearance of colours, materials and finishes may vary depending on your screen, device, lighting and the natural characteristics of the material.

Fragrance is also experienced differently from person to person. Its character and perceived strength may vary depending on factors including:

  • room size and layout
  • airflow and ventilation
  • temperature and humidity
  • diffuser placement
  • device settings and operating schedule
  • the amount and format of fragrance used
  • individual scent perception

Natural materials may contain subtle differences in grain, texture, tone or finish. These variations are part of the material and are not necessarily product faults.

Product images are illustrative and may include styling objects that are not included with the product. The product description and order confirmation will identify what is included.

product use and care

kirri products must be used only for their intended purpose and in accordance with the instructions, care information and safety warnings provided with the product or published on our website.

You are responsible for selecting a product that is suitable for your space and intended use.

Fragrance oils and refills must only be used with compatible products and delivery systems. Using an incompatible oil, refill, accessory or cleaning product may affect performance or damage the product.

Unless a product is specifically described as suitable for skin, consumption or another purpose, fragrance oils and home fragrance products must not be ingested or applied directly to the body.

Keep fragrance products, candles, oils and electrical devices away from children and pets. Follow all placement, ventilation, electrical, candle and fire-safety instructions.

Product performance may be affected by improper use, unsuitable placement, lack of cleaning, unauthorised modifications or failure to follow the supplied instructions.

Nothing in this section limits your rights where a product does not meet a guarantee under Australian Consumer Law.

prices and currency

Prices are displayed in the currency selected on the website or indicated at checkout.

Unless stated otherwise, prices displayed for Australian customers include goods and services tax where applicable.

Delivery charges, duties, taxes and other applicable costs will be displayed or described before you complete your order where reasonably possible.

Prices may change without notice. A price change will not affect an order we have already accepted.

Where a price or product detail has been displayed incorrectly, we may contact you before accepting or fulfilling the order. You may choose to proceed at the correct price or cancel the affected item for a refund.

placing an order

Submitting an order is an offer to purchase the selected products on these terms.

After an order is submitted, you will usually receive an email confirming that we have received it. This acknowledgement does not necessarily mean that the order has been accepted.

An order is accepted when we confirm dispatch, provide an express acceptance or otherwise begin fulfilling the order.

We may decline or cancel an order before acceptance where reasonably necessary, including where:

  • a product is unavailable
  • payment cannot be authorised
  • the order information appears incorrect or incomplete
  • there is an obvious pricing or product-description error
  • we reasonably suspect fraud, misuse or unauthorised resale
  • delivery is unavailable to the supplied address
  • purchase limits or promotion conditions have been exceeded
  • accepting the order would breach a legal or regulatory requirement

Where payment has already been taken for an order we do not accept, we will refund the relevant amount to the original payment method.

product availability

Products, scents, formats and offers are subject to availability.

An item appearing on the website is not a guarantee that it will remain available. Stock levels may change before an order is accepted or fulfilled.

Where an ordered product becomes unavailable, we may contact you to offer:

  • a revised dispatch date
  • a suitable alternative
  • removal of the unavailable item
  • cancellation and a refund for the affected item

We will not substitute a product without your agreement.

pre-orders

Products offered on pre-order will include an estimated availability or dispatch period where known.

Pre-order dates are estimates and may change due to production, freight, customs, supplier or other circumstances outside our reasonable control.

Where a material delay occurs, we will provide an update and any options required under applicable law.

Products purchased with a pre-order item may be held and dispatched together unless split delivery is offered or arranged.

payment

Payment must be made using one of the payment methods available at checkout.

You confirm that:

  • you are authorised to use the selected payment method
  • the payment and billing information supplied is accurate
  • sufficient funds or credit are available
  • the payment is not connected with fraudulent or unlawful activity

Payments may be processed by third-party payment providers. Their separate terms and privacy practices may also apply.

We may carry out reasonable verification or fraud-prevention checks before accepting an order.

discount codes and promotions

Discount codes, gifts with purchase, bundles and promotional offers are subject to the conditions stated with the offer.

Unless stated otherwise:

  • offers are available for a limited time
  • offers are subject to stock availability
  • one discount code may be used per order
  • discount codes cannot be combined
  • codes cannot be exchanged for cash or applied retrospectively
  • minimum purchase amounts exclude delivery charges
  • free gifts cannot be exchanged for cash
  • returned items may affect eligibility for a promotional gift or discount
  • offers may be limited to particular products, customers, regions or sales channels

We may withdraw or correct a promotion where it contains an error, has been misused or cannot reasonably continue. This will not affect an order we have already accepted unless required by law or agreed with you.

gift cards and store credit

Gift cards and store credit are subject to any conditions displayed when they are issued or purchased.

They may only be redeemed through the eligible kirri sales channel and cannot ordinarily be exchanged for cash, except where required by law.

You are responsible for keeping gift card and store credit details secure. Please contact us promptly if you believe they have been lost, stolen or used without permission.

Any expiry date will be displayed or communicated in accordance with applicable law.

subscriptions

Where you purchase a subscription, the price, delivery frequency, included products, renewal arrangements and any applicable minimum term will be shown before you complete the purchase.

By starting a subscription, you authorise us or our payment provider to charge the selected payment method at the agreed frequency until the subscription is cancelled or otherwise ends.

You are responsible for maintaining current payment, billing and delivery information.

Subscription orders may be processed automatically before each scheduled dispatch. Changes or cancellations must be completed before the applicable processing or cut-off date shown in your account or subscription terms.

You may manage an eligible subscription through the subscription portal or by contacting our customer care team.

Where a payment cannot be processed, we may retry the payment, contact you or pause or cancel the subscription.

We may change subscription pricing or material subscription terms by providing reasonable advance notice. A change will not apply retrospectively to an order that has already been processed.

Any subscription-specific terms displayed at the time of purchase form part of these terms. Where there is an inconsistency, the more specific subscription terms will apply to that subscription.

Your rights under Australian Consumer Law continue to apply to subscription products and services.

delivery

Delivery options, estimates and charges will be displayed at checkout or within our shipping information.

Delivery dates are estimates unless we expressly agree to a guaranteed delivery date.

Delivery may be affected by:

  • stock availability
  • order volume
  • the delivery address
  • courier capacity
  • weather or transport disruptions
  • customs or border processing
  • public holidays
  • events outside our reasonable control

You are responsible for providing a complete and accurate delivery address.

Where an order is returned because the address was incorrect, incomplete, refused or unattended, additional delivery charges may apply before it is sent again.

Authority-to-leave deliveries may be left in a location considered reasonably safe by the carrier. Where you request or accept authority to leave, you accept the risks associated with the parcel being left unattended, except to the extent loss or damage was caused by our failure to take reasonable care or cannot lawfully be excluded.

Please contact us promptly if an order is missing, damaged or appears to have been delivered incorrectly.

international orders

International orders may be subject to customs duties, import taxes, brokerage charges or local fees imposed by the destination country.

Unless checkout expressly states that these charges are included, the recipient is responsible for paying them.

Customs authorities may require identification, tax information or other details before releasing an order. We are not responsible for customs decisions or requirements outside our reasonable control.

Some products may not be available for delivery to every country due to carrier, safety or import restrictions.

returns, refunds and warranties

Our returns, refunds and warranty policy forms part of these terms and explains our processes for:

  • change-of-mind returns
  • faulty, damaged or incorrect products
  • refunds and exchanges
  • product warranty claims
  • return shipping and assessment

Change-of-mind conditions do not apply where a remedy is required under Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under Australian Consumer Law. You may be entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage.

You may also be entitled to have goods repaired or replaced where they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms or another kirri policy excludes, restricts or modifies these rights.

smart diffusers, applications and connected services

Some kirri products may connect with a mobile application, wireless network or third-party platform.

Compatible devices, operating systems, internet access or account registration may be required. You are responsible for maintaining compatible equipment and internet access.

Connected features may occasionally be affected by software updates, maintenance, network conditions or third-party services outside our reasonable control.

We may release updates intended to maintain security, compatibility, functionality or performance. You should install relevant updates and follow the current operating instructions.

Nothing in this section limits your rights where a connected product or service does not meet a guarantee under Australian Consumer Law.

reviews and other submitted content

You may be able to submit reviews, photographs, videos, comments, feedback or other content.

You retain ownership of the content you create. By submitting content to us or tagging kirri in content that you invite us to share, you give kirri a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display that content for purposes connected with our business, marketing, website and social channels.

This licence continues unless you ask us to stop using the content where it is reasonably possible for us to do so. It does not require us to remove material already printed, distributed or incorporated into completed campaigns.

You confirm that:

  • you created the content or have permission to submit it
  • the content is accurate where it describes your experience
  • the content does not infringe another person’s rights
  • any paid, gifted or commercial relationship has been disclosed where required
  • the content is not unlawful, abusive, deceptive, defamatory or harmful

We may moderate or remove content that breaches these terms, applicable law or our publishing standards. We will not edit a review in a way that changes its meaning or creates a misleading impression.

intellectual property

The website and its contents are owned by, or licensed to, kirri and are protected by intellectual property laws.

This includes our:

  • business name and trade marks
  • logos and visual identity
  • product names and packaging
  • photographs, illustrations and videos
  • written copy and fragrance descriptions
  • product and website designs
  • graphics, icons and layouts
  • educational and downloadable material
  • software and digital content

You may view and use the website for personal, non-commercial purposes.

You must not reproduce, modify, distribute, publish, sell, license or commercially use our intellectual property without prior written permission, except where permitted by law.

No use of the website transfers ownership of any kirri intellectual property to you.

third-party services and links

Our website may contain links to or integrate with services operated by third parties, including payment providers, social media platforms, couriers and application services.

Third-party services are governed by their own terms and privacy policies.

We are not responsible for third-party content, availability or practices outside our reasonable control. A link does not necessarily mean that kirri endorses the third party or all of its content.

Our privacy policy explains how we collect, hold, use and share personal information.

By using our website, you acknowledge that your personal information will be handled in accordance with that policy and applicable privacy laws.

security

We use reasonable measures designed to protect our website and systems. However, no website or electronic transmission can be guaranteed to be completely secure or uninterrupted.

You are responsible for using suitable security measures on your own devices and accounts.

Please contact us promptly if you become aware of suspected fraud, unauthorised access or a security issue connected with your kirri account.

liability

Nothing in these terms excludes, restricts or modifies a right, guarantee, condition, warranty or remedy that cannot lawfully be excluded or limited.

To the extent permitted by law, kirri is not responsible for loss or damage caused by:

  • using a product contrary to its instructions or intended purpose
  • using incompatible oils, refills, accessories or electrical equipment
  • unauthorised modifications, repairs or alterations
  • inaccurate information supplied by you
  • interruptions caused by third-party networks or services outside our reasonable control
  • events outside our reasonable control

Any limitation applies only to the extent permitted by law and does not affect your rights under Australian Consumer Law.

events outside our control

We will not be responsible for a delay or failure caused by circumstances outside our reasonable control, including severe weather, natural disasters, fire, flood, industrial action, transport interruption, border restrictions, government action, telecommunications failure, cyber incidents affecting third parties or supply-chain disruption.

Where such an event affects an accepted order, we will take reasonable steps to minimise the delay and communicate any material impact.

Your rights under applicable law continue to apply.

ending access to the website

You may stop using the website at any time.

We may suspend or end your account or access where reasonably necessary because:

  • you have materially breached these terms
  • we reasonably suspect fraud or unlawful activity
  • your use creates a security or operational risk
  • we are required to do so by law
  • the relevant service is being discontinued

Ending access does not affect rights, obligations or orders that arose before access ended.

changes to these terms

We may update these terms where our website, products, services, business practices or legal obligations change.

The current version will be published on this page with the date it was last updated.

Changes will apply from the published effective date and will not retrospectively alter an order we have already accepted.

Material changes affecting an active subscription or ongoing service will be communicated where reasonably required.

general provisions

If any part of these terms is found to be invalid or unenforceable, the remaining terms will continue to apply.

A delay in exercising a right under these terms does not mean that right has been waived.

These terms, together with the policies and specific conditions referred to in them, form the agreement between you and kirri concerning your use of the website and applicable purchases.

governing law

These terms are governed by the laws of Victoria, Australia.

You and kirri submit to the courts of Victoria and any courts entitled to hear appeals from them.

Nothing in this section prevents you from exercising any rights available under applicable consumer law in your state, territory or country.
